Embracing AI in Law Firms: Why We Should Pay Attention

I write this as an AI consultant who regularly advises law firms. AI (artificial intelligence) may sound technical, but it can be explained in everyday terms. In essence, AI tools are software programs that can learn from data and perform tasks that normally require human intelligence - from scanning documents to drafting text. Think of them as super-fast assistants that can read, write, or analyze information. Over the past year we’ve seen legal-specific AI tools (like Westlaw Edge or Lexis+ AI) alongside general-purpose chatbots (like ChatGPT) enter law practice. As lawyers, you must understand these tools so you can use them wisely. In fact, the ABA’s updated ethics rules explicitly say that staying competent now includes “the benefits and risks” of relevant technology. In this post, I’ll explain the current state of AI in law firms, why it’s increasingly necessary, concrete ways AI is already helping lawyers, ethical concerns and ABA guidance, and common pitfalls to avoid.


Current State of AI in Law Firms


The chart below illustrates the surge in AI adoption among law firms. According to the American Bar Association’s 2024 Legal Technology Survey, about 30% of law firms report using AI tools in their work - roughly triple the rate from a year earlier. Adoption is growing fastest at larger firms: about 46% of firms with 100+ attorneys use AI. Mid-size firms (10–49 lawyers) are around 30%, and even solo practitioners are up to roughly 18% (from near zero a couple of years ago). Notably, many more lawyers say they’re considering AI adoption – another 15% of respondents – which means these numbers are likely to keep rising soon.

The tools themselves span a range. For legal research and drafting, ChatGPT leads by adoption – over half of firms using or evaluating AI mention it. Specialized legal AI platforms are also popular: for example, Thomson Reuters CoCounsel is used (or being considered) by about 26% of firms, and Lexis+ AI by 24%. These numbers come from a survey of 512 attorneys across firms of all sizes, which also found that “saving time/increasing efficiency” is by far the top reason firms turn to AI (54% cited it). The takeaway is clear: AI is no longer niche. Even small firms are experimenting, and nearly half of firms expect AI to be “mainstream” within 3 years.


Why Law Firms Need AI


In today’s market, law firms face intense pressure to work faster and smarter. Clients demand cost-effective, efficient service, and many routine legal tasks involve sifting through huge volumes of information. AI excels at data-heavy, repetitive work. Studies suggest a significant share of a lawyer’s workload is automatable – one report found about 23% of a lawyer’s tasks could already be automated with today’s technology. For example, tasks like e-discovery review, contract analysis or basic legal research follow patterns that AI can handle well. By offloading those tasks, lawyers free up time for higher-value work (thinking creatively, counseling clients, strategizing).


This isn’t optional fluff; it’s a matter of staying competitive. Technology-savvy clients and in-house departments increasingly expect their law firms to leverage modern tools. Surveys consistently find that clients expect lawyers to use technology competently. In fact, the ABA’s FLIP report notes “clients expect law firms to use technology and for lawyers to be competent and sophisticated in [its] use”.   Firms that embrace AI tools can reduce costs (by doing work faster), improve accuracy (machines don’t get tired flipping through documents), and gain an edge over firms that lag behind. This trend is backed by data: the ABA’s 2025 Legal Industry Survey found 54% of lawyers use AI to draft correspondence, and 47% were interested in tools to analyze firm data. Even beyond strictly legal tasks, firms are using AI for billing analytics, scheduling, and financial decisions.


Moreover, it’s an ethical imperative under the Model Rules. ABA Model Rule 1.1 (Competence) has been clarified to require lawyers to keep up with tech changes, since tech is now part of “the practice of law”. In practice, failing to adopt useful AI tools, or at least understand them, could mean falling behind in competence. As one ABA article bluntly put it, lawyers who are “proudly unaware of technology” today are “setting [themselves] up for ethical violations”. In short, AI isn’t just a cool gadget; it’s rapidly becoming essential for providing competent, efficient legal services.


What AI Can Do in a Law Firm


AI tools in law firms are typically assistants, not replacements. They speed up and augment work we already do. Here are some concrete examples:


  • Document Review and Analysis: AI can scan thousands of pages in seconds. E-discovery platforms and contract-analysis tools highlight key clauses, flag unusual terms, and even suggest revisions. For instance, a controlled study showed an AI tool reviewing NDAs outperformed human lawyers – it was 94% accurate vs 85% for lawyers, and it finished a batch of documents in 26 seconds compared to 92 minutes by lawyers

  • Legal Research: Advanced AI assistants can find case law, statutes, and prior briefs with natural language queries. Instead of wading through pages of results, a lawyer can ask an AI chatbot to summarize relevant cases or even compare statutes across jurisdictions. Many platforms (like Westlaw Edge or Lexis+ AI) now integrate machine-learning to sort and highlight key passages. In surveys, firms cite document review and research as primary AI use cases. In fact, 52% of lawyers using AI named ChatGPT, but many of the others are legal-specific tools like CoCounsel or Lexis+.

  • Drafting and Writing: AI can generate first drafts of memos, emails, briefs or client letters. You might feed it a set of facts and get a draft outline or summary. Lawyers then refine the draft – editing and verifying every part. Even if AI “hallucinates” or makes mistakes, it often saves time by doing bulk writing that a lawyer might have dreaded. According to the ABA survey, over half of lawyers using AI are leveraging it to save time/increase efficiency, which often means speeding up drafting.

  • Predictive Analytics: Some AI services analyze past cases or judge rulings to give statistical insights. For example, a firm might use AI to gauge the likely outcome of a motion based on how similar cases fared. While these predictions aren’t infallible, they can inform strategy or settlement decisions.

  • Practice Management: AI tools are also helping with business tasks. Time-tracking AI can suggest billing categories for unbilled hours. Scheduling assistants can coordinate meetings. Chatbots on a firm’s website can handle routine client intake questions. As one industry report noted, lawyers increasingly use AI outside of legal work – 54% use AI to draft correspondence and significant percentages use it for data analysis and business insights.

The key point is that lawyers stay in charge. AI tools can do a lot of legwork, but a lawyer checks the work. I always tell lawyers: think of AI like a junior associate who is very fast at sorting and writing drafts, but who can also make confident mistakes. The lawyer must guide the AI, verify its results, and use professional judgment. Done correctly, AI can significantly boost productivity.


Addressing Concerns: Ethics, Confidentiality, and Responsibility


Naturally, lawyers have concerns about AI - and they should. The good news is that the existing ABA Model Rules already cover these concerns. We don’t need a new rule book; we just apply familiar rules to this new technology.


  • Competence (Model Rule 1.1): As noted above, lawyers must be “technologically competent.” The ABA’s Formal Opinion 512 reminds us that we have to “understand AI’s capabilities and limitations” and adopt a “trust but verify” approach. In plain terms, we must know enough about the AI tools we use to supervise them effectively. This means learning how an AI generates answers, and never blindly accepting AI output without checking it. Courts have already punished lawyers for misusing AI: in at least two recent cases, lawyers were sanctioned for filing briefs containing AI-made citations to cases that didn’t exist. These mistakes happened because the lawyers trusted the AI instead of verifying its facts. So the lesson is clear: verify everything. If AI provides a citation or a legal rule, double-check that it’s real and correct. Your professional responsibility requires it (Rule 1.1 and Rule 3.3).

  • Confidentiality (Model Rule 1.6): Lawyers must protect client data, and using AI can raise risks. Many popular AI systems are “cloud-based” and continuously learning, which means whatever data you input might be used to train the model. ABA guidance warns that using such tools on confidential information could violate Rule 1.6. In practice, this means being very careful about feeding sensitive client details into an AI prompt. If you use AI, know its privacy terms. Some firms solve this by using on-premises AI systems or tools with strict data controls. Others simply redact any confidential info before querying the AI. Also consider Model Rule 1.4: if the use of AI might affect a client’s confidentiality or outcome, you may need to tell the client what you’re doing. Transparency helps build trust.

  • Supervision & Unauthorized Practice (Rules 5.1, 5.3, 5.5): AI can’t be left unsupervised any more than a paralegal could. Model Rule 5.3 (supervising non-lawyers) is often applied by analogy to AI: the lawyer remains responsible for any work delegated AI. And Rule 5.5 makes clear that only licensed attorneys can give legal advice or exercise legal judgment. If an AI tool is allowed to dispense “advice” on its own, that’s problematic. Always ensure a lawyer is making the final judgment call on any legal advice or document. As one ethics panel put it, “AI is here to stay…but lawyers must not relinquish their responsibility to AI by adopting AI-produced content without reviewing every word”.

  • Accuracy & Candor (Rules 3.1, 3.3, 8.4): The ABA emphasizes that AI output cannot be misleading or false. Rules 3.1 and 3.3 forbid making frivolous or false claims in court. So if an AI invents a case or misstates a law, submitting that to a judge would violate those rules. In short, “I trusted the AI” is not a valid excuse. We must treat AI output like a paralegal’s work product: review it carefully.


The bottom line is that AI brings no new ethical rules - we apply the old ones to new tools. The ABA’s 2024 Formal Opinion 512 made this point: all existing rules (competence, confidentiality, candor, supervision) already govern our use of AI. AI actually emphasizes key lawyerly skills: accountability and judgment. It can be a powerful assistant, but only if we use it thoughtfully and ethically.


Pitfalls to Avoid When Adopting AI


Having seen the benefits and rules, it’s tempting to dive in. But there are common traps law firms should avoid:


  • No Clear Plan or Alignment: Don’t chase AI for AI’s sake. A frequent mistake is adopting flashy technology without a goal. An ABA article warns that firms need “clear, purposeful planning” to avoid misaligned or overly complex tools. Start by identifying a real pain point (e.g. document review backlog) and then evaluate AI solutions targeted to that problem.

  • Overlooking Training and Adoption: Lawyers are human, and many are cautious about new tech. If you roll out an AI platform but don’t train the team or show the benefit, they’ll just ignore it. One expert notes lawyers must see immediate, direct benefits and that training is crucial. Make sure to involve your attorneys early, provide user-friendly tools, and even incentives. Early-adopter “champions” can help others learn. Without buy-in, AI tools sit unused.

  • Underestimating Complexity: Some AI tools can be technically complex. Avoid solutions that require extensive setup or huge data projects unless you have the resources. Focus on tools that integrate smoothly into existing workflows. In fact, firms in surveys say they prioritize AI that “integrates seamlessly with existing systems”. If your new AI creates more paperwork or troubleshooting, it won’t save time in the long run.

  • Neglecting Data Governance and Security: The ABA emphasizes that with AI (and any tech), privacy and compliance are key. That means setting policies for what data can go into AI tools, how results are stored, and who has access. Encrypt data, use secure connections, and verify vendor security claims. If you adopt an AI service, treat it like any third-party vendor: review its security and privacy certifications.

  • Blind Trust / Hallucinations: As mentioned, AI can “hallucinate” facts. Do not let it churn out a contract or motion that you file without proofing. A nightmare scenario: submitting a brief that cites non-existent cases. We’ve seen real-world sanctions for exactly that. Always double-check AI outputs.

  • Ignoring Ethical Costs: Efficiency gains are great, but don’t ignore how billing and ethics intersect. ABA Opinion 512 points out that billing must reflect actual work done. If AI cuts the time, fee-splitting or overcharging could become an issue. Be transparent in billing for AI-assisted work (some have proposed reduced rates for paralegal-level AI tasks, for example).

  • Lack of Continuous Evaluation: AI technology is evolving rapidly. Don’t treat any solution as “set it and forget it.” Monitor your AI’s performance, update tools when better versions come out, and reevaluate your strategy annually. A good habit is to measure outcomes: e.g., track how much time a tool actually saves, or compare AI drafts vs. old drafts for quality.


By planning carefully, training people, and keeping our ethical guardrails, we can avoid these pitfalls. Remember, AI is a tool: sharpen it correctly and it makes everyone’s work better; misuse it and it can cause more headaches than it solves.


Conclusion


In sum, AI is reshaping legal practice. As an AI advisor, I encourage every law firm to learn about and experiment with these tools while respecting our professional duties. The metrics and surveys are clear: adoption is rising fast because efficiency and client demand are pulling us forward. At the same time, the ABA and other bar authorities have made clear that we cannot outsource judgment. We must use AI to enhance our work, not replace our ethical obligations


For lawyers, mastering AI is about balance. It means embracing powerful new capabilities (like rapidly reviewing documents or drafting proposals) while critically evaluating every result. When done right, AI helps us deliver better legal service. And ultimately, our role remains the same: to apply legal knowledge, reasoning, and human insight in the service of our clients. AI just gives us a faster, smarter partner in that mission.
